Dacthal Investigation | What is DCPA?
On August 6, 2024, the EPA issued an Emergency Order that called for the immediate suspension of all Dacthal pesticide registrations, stating, “DCPA is so dangerous that it needs to be removed from the market immediately. It’s the EPA’s job to protect people from exposure to dangerous chemicals. In this case, pregnant women who may never even know they were exposed could give birth to babies that experience irreversible lifelong health problems.”
Dimethyl tetrachloroterephthalate (DCPA) is a chemical compound that is primarily used in the production of herbicides, insecticides, and pesticides. Common products that contain DCPA include:
- Dacthal
- Dacthal W-75
- Dacthal Flowable Herbicide
- Dacthal 6F
- DCPA 75WDG
- DCPA 6E
- DCPA 75 DF
These products have been used for various agricultural and residential purposes including:
- Crops, including broccoli, Brussels sprouts, cabbage, and onions
- Lawns
- Golf courses
- Parks
- Playgrounds
Recent findings have linked DCPA to severe birth defects in children whose mothers were exposed during pregnancy, including low birth weight, impaired brain development, lower IQ, and impaired motor skills later in life.

Typically, we represent clients on contingency fee agreements. If we take your case under a contingency fee arrangement, you won’t owe our firm any legal fees unless we are able to recover money for you.
Our contingency fee agreements are usually based on a percentage of the amount we recover for our clients. The contingency fee amount is determined by the type of case, our estimate of how long it will take to resolve your case, and our estimate of the litigation costs we will advance in your case. Each engagement agreement includes the details of the fee arrangement. Questions about our fee agreements are welcomed and encouraged.
In most litigation matters, it is extremely difficult – practically impossible – to predict how long it will take to resolve a particular case. Every case is different, and we will do our best to provide you with an estimate based on your case and our experience with similar cases. Moreover, we will do our best to keep you updated and manage expectations along the way.
