Dicamba Drift Lawsuit | South Dakota Dicamba Damage
Dicamba Drift Lawsuit – Since the approval of Dicamba use in South Dakota in 2017, the number of complaints to the Department of Agriculture have continued to flood in. According to a recent report by Angela Kennecke of Keloland Media, “the number of complaints coming into the Department of Agriculture grew by 150 percent.”
“Regulatory sanctioned vandalism by the state of South Dakota to allow this product to be used on the landscape here in South Dakota,” Organic Farmer Charlie Johnson said.
Dicamba has quickly become known as an herbicide that is “pitting farmer against farmer” for the benefit of big chemical companies like Monsanto, BASF, and DuPont. As stated in the Keloland Media report, “Whether you’re concerned about the chemical’s effect on the environment, or the economic repercussions of thousands of acres of crop damage, Dicamba Drift is an issue that affects everyone in an agricultural state like South Dakota.”
Part 1: Dangerous Dicamba Drift
Angela Kennecke of Keloland Media reports:
As recently published in our blog, the JPML found the actions (by farmers and land owners) shared factual questions arising from “the development, testing, and marketing of Monsanto’s dicamba-resistant Xtend seeds and three dicamba herbicides’ – XtendiMax, Engenia, and FeXapan” and also found the cases “may necessitate significant discovery into defendants’ various business agreements and arrangements.”
Peiffer Wolf Carr & Kane attorneys Paul Lesko and Brandon Wise are counsel in the Smokey Alley, et. Al. v. Monsanto, et al., which was already pending in St. Louis. With an office located in St. Louis, PRW attorneys are looking forward to engaging in this multi-district litigation.
Dicamba Drift Lawyers | Dicamba Crop & Plant Damage
Attorney Paul Lesko of Peiffer Wolf Carr & Kane continues to be a leader in the charge against Monsanto, BASF, and DuPont. Peiffer Wolf Carr & Kane is fighting on behalf of farmers and landowners across the country; the complaints allege that Monsanto, BASF, and DuPont sold a defective product to farmers and growers.
We’re bringing claims of product liability because farmers are in a quandary. They want to plant seeds of their choice, but due to damage potential, have to consider buying dicamba-tolerant soybeans from a defensive position. We also have anti-trust issues. As discovery is ongoing, we believe the evidence will show Monsanto and BASF knew more dicamba damage would lead to increased sales.
Dicamba Used for 2017 Growing Season | Dicamba Drift
Three new formulations of dicamba were approved for the 2017 growing season, which were supposed to be less harmful than prior versions of dicamba:
- XtendiMax by Monsanto
- Engenia by BASF
- Fexapan by Dupont
However, as previously noted, these dicamba formulations were introduced to the market without independent rigorous testing. “As a result, millions of acres of farmland have been damaged in a real life science experiment conducted by Monsanto and the other manufacturers of dicamba at the farmers’ expense,” PRW attorney Paul Lesko stated.
The growers, farmers, and landowners are fighting for a settlement to cover the millions of dollars of direct plant and crop losses, as well as the cost of protecting their crops, plants, and land from unintended dicamba drift damage.
